WILLS and FAMILY

MARRIAGE

Marriage automatically revokes a previous will, unless the will was made in contemplation of that marriage. Therefore it is important that new spouses should consider making new wills.

DIVORCE

If a person makes a Will and then subsequently gets divorced, then the will is still valid but the part of it that relates to the former spouse is revoked. The Will is treated as if the former spouse had died on the date of the divorce.

SEPARATION

If a person makes a Will and then separates from their spouse then the Will is still valid and any part of it that relates to the spouse is still valid.
