As detailed on our other pages, if a person is deemed to have a health need then the NHS fund the entire cost of care. This concept is not widely known so you may have read these pages and thought that your relative shouldn’t be/have been paying for their care. You do have the right to commence what is known as a retrospective review for past periods of care.
Unfortunately, the right to commence a retrospective review does have deadlines to apply.
The latest deadline was July 2014 so currently you can only commence a retrospective review back to July 2013. However, with the high price of care, this can be a tremendous amount of money. Furthermore, you have the right to claim interest on any outstanding amount.
The following people are most likely to have missed out on NHS fully funded care that they were entitled to, and therefore due a refund of care fees;
- Those discharged straight from Hospital into a care home
- Those that were never assessed during a period of care (and possibly misled by the NHS)
- An individual who was assessed for NHS Continuing Healthcare, rejected but their health needs increased
- Those who received NHS Nursing Care who never had the full assessment for NHS Continuing Healthcare
